1. Our Service

ImgUpscaler provides online tools for image upscaling, image enhancement, previewing, downloading, account management, credits, subscriptions, billing, and related support. We may update, improve, limit, suspend, or discontinue parts of the service as needed for product, security, operational, or legal reasons.

2. Accounts and Authentication

Some features may require an account. You are responsible for keeping your login credentials secure and for activity that occurs under your account. If you sign in with Google or another supported provider, you authorize us to use the account information described in our Privacy Policy to create or identify your ImgUpscaler account and provide account-related features.

3. Your Content and Permissions

You keep ownership of the images, files, prompts, and other content you upload or submit to ImgUpscaler. You grant ImgUpscaler and our service providers a limited permission to host, transmit, process, transform, preview, and store your content only as needed to provide the service, operate security checks, troubleshoot issues, and comply with legal obligations.

Uploaded images and generated results are not stored as long-term assets and are automatically removed within 24 hours after processing, as further described in our Privacy Policy.

4. Your Responsibilities

You agree to use ImgUpscaler lawfully and responsibly. You must not upload, generate, process, or distribute content that violates applicable law, infringes intellectual property or privacy rights, contains malware, exploits minors, promotes abuse, or is otherwise harmful.

• Do not probe, scan, attack, overload, or disrupt our systems.
• Do not bypass access controls, rate limits, payment checks, or security features.
• Do not use automated systems to create accounts or abuse free trials, credits, or promotions.
• Do not resell access to ImgUpscaler without our written permission.
• Do not upload content unless you have the rights and permissions needed to process it.

5. Output and Usage Rights

Subject to these Terms and applicable law, you may use downloaded results for personal or commercial purposes. You are responsible for reviewing output before use and for ensuring that your use of input and output content complies with applicable laws, third-party rights, platform rules, and professional requirements.

6. Credits, Payments, and Subscriptions

Paid plans, credits, or subscriptions may be offered through ImgUpscaler or our payment providers. Prices, included usage, renewal terms, and feature limits are shown at checkout or on the pricing page. You authorize us and our payment providers to charge applicable fees, taxes, and renewal payments based on the option you select.

7. Refund Policy

We offer a 7-day refund window for eligible paid ImgUpscaler purchases unless otherwise stated at checkout or required by law. To request a refund, contact support@imgupscaler.com with your order number, account email, and a short description of the issue. Approved refunds are returned to the original payment method and may take several business days to appear depending on the payment provider.

8. Third-Party Services

ImgUpscaler may integrate with third-party providers for hosting, authentication, analytics, image processing, payments, email delivery, customer support, and security. Third-party websites and services are governed by their own terms and privacy policies. We are not responsible for third-party content, services, or policies.

9. Disclaimers

ImgUpscaler is provided on an "as is" and "as available" basis. We aim to provide reliable and useful tools, but we do not guarantee that the service will be uninterrupted, error-free, secure, or suitable for every purpose. AI-generated or enhanced output may contain mistakes, artifacts, or unexpected changes.

10. Limitation of Liability

To the maximum extent permitted by law, Sparklightforce Limited and ImgUpscaler will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities. Our total liability for any claim relating to the service is limited to the amount you paid to ImgUpscaler for the service giving rise to the claim during the 12 months before the claim arose.

11. Suspension and Termination

You may stop using ImgUpscaler at any time. We may suspend or terminate access to the service if we believe you violated these Terms, created risk for other users or our systems, used the service unlawfully, or failed to pay applicable fees. We may also remove or restrict content when required for legal, safety, or operational reasons.

12. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will post the updated Terms on this page. Your continued use of ImgUpscaler after changes become effective means you accept the updated Terms.
